Australian Council for Children and Youth Organisations Inc ('ACCYO') Accreditation Program for Safeguarding Children
Terms and Conditions of Accreditation
Any organisation that satisfactorily completes and implements the ACCYO Accredited Program for Safeguarding Children (the ACCYO Program) agrees, as a condition of receiving accreditation from ACCYO that it has done so (ACCYO accreditation), to be bound by and act in accordance with the following terms and conditions.
1. The organisation's term of ACCYO accreditation is for a period of three (3) years commencing on the day ACCYO issues to the organisation a certificate confirming the ACCYO accreditation (the ACCYO certificate).
2. The organisation undertakes and acknowledges that:
(a) the ACCYO certificate certifies that the organisation has, as at the date of the ACCYO certificate, satisfactorily completed and implemented the ACCYO Program which is the subject of the ACCYO certificate;
(b) the ACCYO certificate does not provide any warranty by ACCYO to the organisation or any other person of the organisation's ongoing compliance with the ACCYO Program which is the subject of the ACCYO certificate whether during the period of ACCYO accreditation or otherwise; and
(c) it will implement, and continue to implement and maintain, throughout the term of ACCYO accreditation, the ACCYO Program which is the subject of the ACCYO certificate.
3. During the term of ACCYO accreditation and for a period of at least 6 years after the expiry of the term of ACCYO accreditation, the organisation shall maintain a policy of insurance which indemnifies the organisation against any claims by any person for breach of professional duty for a sum of at least $1million ($1,000,000) for any one claim.
4. During the term of ACCYO accreditation, the organisation shall maintain a policy of insurance which indemnifies the organisation against any claims by any person for personal injury (including death or illness) and property damage for an amount of at least $1million ($1,000,000) for any one occurrence.
5. The organisation hereby releases and forever discharges ACCYO, its directors, officers, servants and agents from, and indemnifies and forever holds ACCYO, its directors, officers, servants and agents harmless against, all claims, demands, suits, causes of actions, costs or expenses whatsoever which it now has or at any time hereafter may have had against ACCYO arising from or connected with or in any way related to the ACCYO Program which is the subject of the ACCYO certificate, the ACCYO accreditation, the organisation's completion and implementation of the ACCYO Program which is the subject of the ACCYO certificate, the organisation's compliance with the ACCYO Program which is the subject of the ACCYO certificate, whether during the period of accreditation or otherwise, and any matters incidental thereto.
6. The organisation hereby indemnifies and forever holds ACCYO, its directors, officers, servants and agents harmless against all claims, whether or not such claims are the subject of legal or other proceedings, made by any person against ACCYO, its directors, officers, servants and agents, arising from or connected with or in any way related to the ACCYO Program which is the subject of the ACCYO certificate, the ACCYO accreditation, the organisation's completion and implementation of the ACCYO Program which is the subject of the ACCYO certificate, the organisation's compliance with the ACCYO Program which is the subject of the ACCYO certificate, whether during the period of accreditation or otherwise, and any matters incidental thereto.
7. Every twelve (12) months from the date of issue of the ACCYO certificate and within twenty eight (28) days of a request being made by ACCYO, the organisation shall complete a self-assessment report, in the form required by ACCYO, as to the organisation's continued compliance and implementation of the ACCYO Program which is the subject of the ACCYO certificate.
8. During the term of ACCYO accreditation and within fourteen (14) days of receiving a request by ACCYO, the organisation shall provide ACCYO with:
(a) a certificate of currency of the organisation's policies of insurance required to be effected and maintained pursuant to clauses 3 and 4;
(b) a written statement concerning the organisation's continued compliance and implementation of the ACCYO Program which is the subject of the ACCYO certificate; or
(c) any documentation or other materials specified by ACCYO concerning the organisation's continued compliance and implementation of the ACCYO Program which is the subject of the ACCYO certificate.
9. During the term of ACCYO accreditation and within five (5) business days of receiving written notice from ACCYO, the organisation shall permit ACCYO, or an auditor appointed by ACCYO, to audit the organisation's implementation of and compliance with the ACCYO Program which is the subject of the ACCYO certificate.
10. Neither the organisation's completion and implementation of the ACCYO Program which is the subject of the ACCYO certificate nor ACCYO accreditation permits the organisation to use the ACCYO logo or any other ACCYO trademarked symbol, design or mark, which use is prohibited except where expressly authorised by ACCYO in writing.
11. Throughout the term of ACCYO accreditation, the organisation must:
(a) display the ACCYO certificate in a place within the organisation's place(s) of business visible by the public; and
(b) provide a copy of these terms and conditions at its own expense to any person on request by such person.
12. ACCYO has and maintains the right to immediately:
(a) suspend or cancel ACCYO accreditation; and
(b) cancel the ACCYO certificate,
at any time during the period of ACCYO accreditation by written notice to the organisation as a consequence of any failure by the organisation to comply with, or for any breach by the organisation of, these terms and conditions.
13. ACCYO reserves the right to amend the requirements of the ACCYO Program at any time as its deems necessary. Accredited organisations will be provided with the amendments on a ‘good faith' basis and must implement the amendments during the accreditation period. Any amendments will be subject to an audit conducted pursuant to clause 9 above.

Terms and Conditions of Pilot Accreditation
Any organisation that satisfactorily completes and implements the ACCYO Pilot Accreditation Program for Safeguarding Children (the ACCYO Pilot Program) agrees, as a condition of receiving accreditation from ACCYO that it has done so (ACCYO pilot accreditation), to be bound by and act in accordance with the following terms and conditions.
1. The organisation's term of ACCYO pilot accreditation is for a period of two (2) years commencing on the day ACCYO issues to the organisation a certificate confirming the ACCYO pilot accreditation (the ACCYO certificate).
2. The organisation undertakes and acknowledges that:
(a) the ACCYO certificate certifies that the organisation has, as at the date of the ACCYO certificate, satisfactorily completed and implemented the ACCYO Pilot Program which is the subject of the ACCYO certificate;
